Expert opinion on behalf of a court

The points to be clarified are formulated in the order of evidence of the commissioning court. The clients are higher regional courts, district courts and local courts. There have been numerous technically exciting and legally interesting court orders in the past. Only with the appropriate court experience can an experienced expert or publicly appointed and sworn expert successfully provide advice on behalf of a party. The procedure is somewhat different for “court opinion machines” on behalf of a court than on behalf of a party.

Either the court will contact you prior to assignment to inquire if the assignment can be processed or it will simply send the file. Publicly appointed and sworn experts must accept court assignments if the task falls within the area of appointment and the advance on costs is expected to cover the costs incurred.

After receipt of the file, the evidence decision must be examined. Can the questions that are important to the court be answered? Is this possible within the scope of the advance on costs obtained?

As a rule, a rough cost calculation is carried out and the court is informed of what costs are likely to be incurred. If this estimate is above the advance on costs, the court will first obtain an increased advance on costs from the parties. Until the further advance is paid to the court, further processing of the expert opinion is suspended.

If necessary, further additional information will be requested through the court or the parties’ attorneys. It is important that there is no direct contact with the parties and the flow of information is always ensured in the direction of both parties. Finally, the publicly appointed and sworn expert is always neutral when he or she provides a “court expert opinion machines” as an expert opinion.

When all the information necessary for the preparation of the expert opinion is available and has been worked through, an on-site meeting is convened via the legal representatives of the disputing parties to the dispute, subject to the necessary deadlines for summoning in accordance with the ZPO. The disputing parties may attend the on-site meeting, but they do not have to. Important for the implementation of the site visit is:

Only the questions of the evidence resolution are answered. Questions that are not asked in the order for evidence will not be answered.

This is a very essential aspect. The evidence order may not be exceeded by the publicly appointed and sworn expert on behalf of a court. The evidence order may only be exceeded if, for example, a “danger to life and limb” is determined during an on-site inspection.  

Finally, the written report is submitted.  It is sent to the court in originals in the number requested by the court. This completes the order.
